Migrant domestic workers in Europe – Law and the Construction of Vulnerability

The approximately 9.5 million domestic workers in Europe play a key role in the sustainability of many families, communities and economies. Their strenuous and often invisible work allows others to turn up to work, spend ‘quality’ time with their children and ensures a dignified standard of life for the elderly and the disabled. Yet, paid domestic work is one of the least valued and protected jobs, commonly carried out by exploited migrant women.

At the seminar, Vera Pavlou shares findings from her book Migrant Domestic Workers in Europe (Hart 2021). The book inquires the role of law in structuring, reinforcing – or, alternatively, alleviating – vulnerability to exploitation. It departs from approaches that frame domestic workers’ exploitation as an issue of ‘modern’ slavery and trafficking, to consider more ‘mundane’, day-to-day vulnerabilities created at the intersection of different legal regimes. Dr Pavlou brings into the discussion the neglected EU law dimension of migration and labour law regimes. Contrary to what has been normally assumed, she demonstrates that most EU labour law sources apply fully to domestic workers including those who lack legal residence. Asserting the applicability of EU labour law opens up the potential to use a whole set of currently underutilised legal sources to challenge dimensions of vulnerability, such as exclusions from working time law.
