Flexibility: Potentials and challenges for labour law

Sammanfattning This essay summarizes an international study on flexibilisation in working life under the auspices of the International Academy of Comparative Law. The full study has been published separately (Flexibility: Potentials and Pitfalls for Labour Law, Acta Societatis Juridicae Lundensis, 1998, ISBN 91-544-2391-0). The article analyses flexibilisation in a global perspective, drawing from some 15 national reports from countries representing several legal systems. Its purpose is analytical, leaving little room for description. Unilateral versus multilateral flexibility is analysed. Flexibilisation as a challenge to entrenched notions is discussed, e.g. "holy cows" and legal shibboleths. Flexibilisation and the established order is studied and the question is asked whether flexibilisation calls for a new balance. Flexibilisation is considered to have increased juridification of labour law. |
