The Universalism of Latin American Labour Law Principles: Can the North Learn Something From the South?

Jurists outside Latin America may not understand Latin American labour law. Latin American labour law jurists often allude to “principles” that lie nowhere in the black letter law, such as the “principle of the primacy of reality”. This principle allows the judge to impose default legal rules on the parties, mostly on employers, even in light of facially legitimate but factually contrary, formalized agreements between workers and employers. Professor Arellano will provide a European audience with an introductory view of the principles of Latin American labour law – protection, labour union autonomy, non-waiver of rights, continuity of the employment relation and primacy of reality – which have seen a rebirth in post-authoritarian Latin America. Arellano will then argue that these principles have universal scope and can be found in the bases of European labour law. They can help us reconstruct global labour law in the post-neoliberal era.
The seminar is open to all comers. No enrolment is necessary, and admission is free of charge.
